Default Potholes?

My and a friend were driving down Maple towards transit in Amherst/Buffalo area in his S10 and hit a nasty pothole and snapped the uppper ball joint on his truck.

Any chance the city has to pay for this at all, or would they just say since the truck is a '95 its negligence on the owners part?

Any WNY guys here who have been on maple by Fillmore hospital know what I'm talking about with the road though
